Legal Question in Family Law in Florida
I got full time custody of my kids in my divorce, my ex got in motorcycle accident 3 months after divorce. He stopped paying child support due to not being able to work, I lost my apt & was homeless w/the kids from there on. A year after that we would have had to live on the street so my ex said to give the kids to him & I did thinking he would end up paying his support again & giving the kids back. I had a letter notorized saying I was giving him temp cust. so they wouldn't bother him for support while he had them. It is now over 3 yrs later & he won't give them back & pay support, I am ordered to pay him now. I have never had a job, I was a housewife while we were married & I have alot of medical problems but would be able to care for them w/his child support. I am unable to make my payments & still homeless going from 1 home to the next w/my now 5 yr old. My question is if I took him back to court, do I have any good chances of winning my kids back since I was supposed to have them from the divorce?
