Legal Question in Traffic Law in Florida

My license is suspended and I want to write a motion to the court so I can start a payment plan on my old tickets. The problem is that this would be my second motion. My first was granted but I wasnt able to pay. My question is this- What should I write to the court exactly? My tickets are in collections and the clerks told me theres a 90% chance they wont grant me the motion because of that and its my second time asking for a motion. Please help and thank you in advance for any and all your knowledgeable help and advice.

Not the write forum for this. Meet with an attorney. Take in documents regarding the tickets you have to pay and the cost of each, the last motion you wrote and any response received and court documents regarding any pending court action.

The attorney will assist you with the correct course of action. It is almost impossible to instruct you what to write with the information you have provided or in this forum. Much more information is needed.

Hello-You said "tickets" as in more than one. If this is the case, you should never just pay them all.

You should contact the Clerk of Court for the County where you got the ticket. Ask what is the status of each ticket? If sent to collections...in Duval Cty, the Clerk has a Motion we file to reopen the case. (This takes it out of collections). If you simply pay the tickets to the collections agency, they add 40%. Also, when we file appropriate Motions, we get the cases consolidated in one Court (if they are in same County) and ask the Court to let us plead to one or two and have the rest dismissed. This way you won't pay fines on the ones dismissed. Also, if you have a lot of tickets, you get a lot of points, unless you get some dismissed in a plea deal.

There are different Motions if the tickets have different status', such as you never went to court or you went to Court, but didn't pay the fine. If your license is susp. due to points, they have a Motion to set aside a prior ticket that had points assessed. That's why I said ask the Clerk for the status of each ticket. Of course, you could hire an atty. to do these things for you...just make sure the atty. has handled these Motions before. Good luck. Tom Rosenblum, Jacksonville
