Legal Question in Personal Injury in Florida

I live in Florida, was involved in an accident 9-1-09..US postal vehicle made a U turn in my path , I hit postal truck...Neither of us issued a citation "due to the uniqeness of the situation" stated the FHP. I just received my copy of accident report which makes me look like the "bad guy" and some of the information on the report is not right. I received a letter from the postal service stating their employee has injuries [he is a 25 yr old male who repeatedly stated he was fine at the accident site] My insurance company-Travelers is on top of this [Postal service is self insured] but I am sure a law suit is coming. Do I need to retain my own attorney? Thank You: Karen

If the postal worker's money damages resulting from the alleged injuries are clearly within your policy limit with Travelers, then you generally will want to avoid spending the extra cash after paying the insurance premium to protect yourself from this precise situation. Your insurer will provide the defense and pay any agreed upon settlement.

If, however, you have a small policy limit for bodily injury and he has, for example, serious injuries requiring surgery, you would have exposure for the amount of damage that exceeds your policy limit, so hiring your own counsel would be the wise move.

How will you know? If it appears you could have potential personal exposure, your insurer should send you a letter stating so.
