Legal Question in Medical Malpractice in Florida

Medical Malpractice

My aunt was injured in an automobile accident on 9/10/08. She was taken to the hospital and released without a cat scan, even though she complained of head pain and had hit her head in the accident. Nearly a week later she went to her family doctor who sent her for a cat scan, which revealed a large hematoma on the right side of her brain. She underwent emergency surgery and is facing months of rehab. Does she have a valid medical malpractice claim against the hospital / doctors who failed to diagnose her?

It sounds like she does have a potential claim. The key will be to see what the emergency room records say. If I can be of any further assistance, please do not hesitate to contact. me.

Thank you for your inquiry. It appears that your aunt may have been misdiagnosed. One of the key issues is going to be what additional injuries did she suffer at a result of the delay in diagnosis and treatment. Re: Medical Malpractice

It appears that she may have a viable claim. Despite the emotional turmoil this has caused your aunt and your family, more needs to be investigated in regards to whether you have a viable lawsuit. Feel free to call me at any time should you have any further questions. Good luck.
