Workers Compensation Question

I was injured in a slip and fall to my knee last year at work after I slipped on someone's ice cube in the lunch room. I've struggled with recovery for the past year and now I'm scheduled for surgery. I didn't have any concerns before but now the new case worker is not returning my calls or assisting me with pre-opp information. I've been calling her and she will not return my call. I'm frustrated that I am paying out personal money *even small amounts* for something that happened at work. Last year I was advised by HR to use my 9 personal days to go on STD.... I was only out 5 days but used or wasted 4 days through this process only to find out that STD paid out 70% and work comp was 60%. I've been frustrated with this whole process and I'm now wondering if I need a lawyer due to the upcoming surgery and massive pain I'm going to be in. Do you advise a lawyer?

Although the workers' compensation statute was intended to be "self executing" so that injured workers did not require attorneys, my experience is that the statute is difficult for the average person to understand and deal with, especially going through the medical recovery process. Based upon what you described above, I would obtain a qualified workers compensation attorney immediately on your case. There is absolutely no reason for you to be paying any money out of your pocket for medical or other expenses, and should not be utilizing personal days in lieu of workers compensation time off.
