Maternity Leave Layoff
My wife's company of 3 yrs outsourced her group and her and a few other employees were ''transitioned'' over to the company receiving the contract. She was ~ 6 months pregnant when the transition started. She is eligible for paid leave in both the new company and the old one but her manager is required to contact the disability provider 24 hrs after she notified him. It's been a week and he has not responded to her multiple attempts to get him to report her short term leave to the provider. She believes that they may be planning to lay her off instead of allowing her leave. She's on bed rest for high blood pressure and this issue is far from helping matters. Is the company within their rights to lay her off before or while on medical leave? Also, is there any recourse for the added stress they've brought which has already lead to my wife being hospitalized for 5 days due to hypertension. This was brought about by a poor transition in which he had to essentially hand-hold her new director to find out who her new manager is and to transfer benefits over from one company to the other. If your wife submits a written request for family medical leave and then her company lays her off, she should consult with an attorney. Many things in life cause stress, and it's probably best not to worry about what might happen in the future.
