Legal Question in Disability Law in Florida

Religious discrimination

Our RV park has always had a church and we have recently grown larger with people from outside the RV park attending. The management has recently decided that attendees from outside the park must be prohibited due to liability. They do not restrict outside participation in card games, jam session, or any other park activity. Is this action discrminatory and can we take any type of action to stop it?

Re: Religious discrimination

It is "discriminatory," but I doubt that it is actionable. The traffic from a big gathering for, say a church service, is much different than a card game.

Re: Religious discrimination

It's hard to say without looking at the insurance policy of the park. It is possible that the park requires or already has insurance coverage for these other activities. They obviously are responsible for the paying tenants but are concerned that they are opening themselves up to liability for the outside guests.

A simple solution would be to require the church to purchase an insurance policy which would cover the attendees and indemnify the RV park.
