Legal Question in Disability Law in Florida

Required info for LTD payments

I worked at my job 4.5 yrs. before i became disabled 5 yrs. ago. I have an autoimmune disease which damaged my kidneys. Although I am off dialysis my renal function is 11% and will never improve. I was given a percentage of my pay for LTD because I did not work there for 5 years. I recently received a letter from a group hired by the company to make sure I was being properly cared for by my doctors. They want me to sign a release for all my medical records from doctors and hospitals. I would think that that a letter from my kidney doctor would suffice. Do they have the right to know all my medical problems? Thank You for your help.

Re: Required info for LTD payments

They do not. They may argue that your medical issues are all related, but the only thing they can legitimately be interested in is ensuring that you are still eligible for benefits. (Which is why they are writing - not to make sure your doctors are caring for you.)

I recommend not giving them access to your records. Rather, ask them what information they need, and then ask your doctor to draft a letter addressing the issues at hand. Have it sent to you first, so you can review it. Then, if it is acceptable to you, you can send it to the company.

Good luck.
