Legal Question in Disability Law in Florida

Revised: Medical & Disability Laws in Florida

I'm disabled American-born Hispanic female with birth defect called PFFD, had several major surgeries throughout my life and worked in several jobs for 37 yrs. In Jan 2009, I had my 2nd hip replacement and recuperation has been difficult for my 53 yr old body (left leg amputation in 1964, right hip replaced in 1995, victim of crime in 2004, and arthritis is spreading through my body). I work for large company in Orlando area for 3.5 yrs and paid my insurance each weekly pay check (I'm single, no children and been an orphan since 13). My 12th week of med leave is approaching and I'm still not doing very good as well as having other health issues develop during my leave. Employer has scheduled 50 hr graveyard week upon my return and I cannot do it. I have FMLA for my disability since 2006 at said job; this is my first medical leave for said surgery. Honestly, it's becoming difficult for me to work full-time; my health is worsening. Said employer has union but I did not join. What are my rights? Where can I look for financial assistance (preparing to file chap 7 bankruptcy for past medical & credit card debts over $50,000). Thank you in advance for any advice.

You should probably sit down with a bankrupcy lawyer. It is really impossible to say whether that option is a good one or not at this point. You may see about joiningthe union. They have a lot of good contacts and resources.
