Fair Credit Reporting Act
As a state agency inspector general, am I required under the fair credit reporting act to obtain permission from 1) an applicant for employment to do a background check, and 2) a present employee to do an employee misconduct inquiry or investigation?

Sorry I cannot answer that question without doing actual legal research...hitting the books....be careful my first instinct would be that the fair credit reporting act would apply and you would have to have consent of the applicant.
