Legal Question in Administrative Law in Florida
Is it legal to disband, write new by-laws and reform an organization??
I am currently President of our Golf league, which is tax exempt but not Inc. and has been in exsitence for approx. 15 years.,By-laws state that to be a member of the league you must also be a member of the golf course where we live and play. Quite a few memebers have dropped their memberships in the golf club which makes them ineligible to play in the league. Three times we have tried to change to by-laws but it gets defeated. Now some members have come up with the idea that we could just disband the league by having the officers resign, then start a new league with new by-laws. My question is this legal (1)? If it is what else had to be done, ie: the tresurary? which has dues paid a year in advance. How will this effect the relationship with the golf club etc?? I need some legal help in order to handle this properly when it comes up. I would appreciate some help THank you.
