Legal Question in Banking Law in Florida
Checking Account
Can a 17 year old open a checking account on their own in Florida?
My daughter opened an account, only used her debit card and now has $525 worth of overdraft fees.
I found out a few days ago that this has happened, took her debit card, sat down with her to explain how to keep track, etc.
My biggest problem is that the first overdrawn was 4 items (some of which would have cleared if they didn't clear on largest amount first), this resulted in $140 fees, took her negative and was still able to use the debit card with the major end result in 15 overdrawals until I found out and was able to intervene.
Thank you in advance.

Re: Checking Account
Certain debts against minors are uncollectable if they are not for necessities such as food, etc. Therefore, the bank may be responsible for these charges. You would need to file a small claims action against the bank requesting they reimburse your daughter since she was a minor at the time of the transaction.
