Legal Question in Banking Law in Florida
i recently made a bank deposit and was given a receipt for the amount deposited. later my account was deducted the check portion of my deposit when i contacted the bank they said there records show the check was cashed and the money given to me. my response was "why would i deposit cash with the check and ask for cash back? and while there was an envelope sent back in the tube i was under the impression it was empty and i threw it away because i was given a receipt that all funds were deposited. i have a photo copy of the deposit slip and it is clearly filled out for the full deposit and the line to sign for cash back is NOT signed. the bank says i should have noticed the weight difference of the envelope (a 42 gram difference, i did the math!) and its my fault for not catching it. this doesn't seem right. can i do anything?
