Legal Question in Bankruptcy in Florida
1) can you still file bankruptcy after you have been served a summons?
2) can you sell anything after the summons has been served to pay for the lawyer?

You can file bankruptcy at any time. You can potentially wipe out a debt before you've been sued or after you've been sued. It makes no difference. Whether the debt can be wiped out in full, however, depends on your income and assets.
