Legal Question in Bankruptcy in Florida

I am 63 yrs old and will be losing my job at end of year. My only income will be social security unless I am lucky enough to get a job. I live in Florida my house is valued at 1/3 of what I owe on it. I will not make enough on ss to keep the house. My question is can I bankrupt the house? I owe nothing else and only have a 6 year old car as an asset. A small 401K. Do I have to wait for the mortgage company to put a judgment on me or can I do something in advance? I don't want to go through the threating phone calls and the possible freeze on my bank account. I only have a couple of thousand in savings but will need it to relocate. I will be able to move in with a family member.

The very best thing you can do is go see a bankruptcy attorney in your area to get all your questions answered. You can file a bankruptcy prior to foreclosure proceedings being filed, or after. And yes, you can get the money owed on the house discharged.
