Is an attorney required to give back a retainer if the matter at hand is discontinued?

It depends on the contract (Retainer Agreement) signed with the attorney. Florida does allow non-refundable retainers, and an attorney may choose to make a portion or all of the retainer non-refundable.
If you have a question about a specific case that you are involved in look at the agreement and it should specify if any of the retainer is considered non-refundable.
