Legal Question in Bankruptcy in Florida
Avoidance of lien
Do you have to file an Avoidance of Lien after filing for bankruptcy...and if so...why? I was told you do or your creditors may still file against you. I don't know what it is, and several attorney's didn't know either.

Although a cr4ditor may not pursue it claims, if a lien exists it is not extinguished automatically. If nothing is done, the lien remains. At the bankruptcy filing part of the relief requested should have been to extinguish such liens. it can be done. if u had counsel, consult with him/her. if not call me 305 940 8080. if i am not available speak with Mr. Stein.
