If you file a Chapter 7 case now, you will not be eligible for a discharge, and the whole reason to file a Chapter 7 is to get a discharge. Note that you could file a Chapter 13 case now, if you are otherwise eleigible as an individual or couple with regular income.
The 8 year period begins on the date that you were discharged in the original case, not the date you filed the original case. You should probably wait the four months. Our office handles a lot of bankruptcy cases. We offer a free initial consultation and would be happy to discuss the situaiton with you.
