If a person previously filed for chapter 7 bankruptcy, how long must they wait before filing a new claim? is it from the date of filing or the actual discharge?

If you filed and never got a discharge, you have to wait 180 days to file again from the date it was dismissed. You received a discharge, then you have to wait 6 years.
