What are the rules in order to convert a Chapter 7 to an 11 if the 7 has not been discharged? What happens with that Trustee do they stay on the case or is a new Trustee appointed?

This is an extremely rare event, but is done by a motion to convert. The Chapter 7 trustee is discharged and is sometimes replaced by a new trustee or trustee committee. The U.S. Trustee remains on the case and generally takes over the duties of the Chapter 7 trustee, unless the judge appoints a Chapter 11 trustee. Chapter 11 bankruptcy is very complex, and you should consult an attorney who handles Chapter 11 cases.
