Legal Question in Bankruptcy in Florida
My brother is filing for chapter 7. His wife started a new job after finishing school that will put them about $2000 over the means test. They haven't cashed any of the wife's paychecks yet and do not want to include her pay for fear of not qualifying for chapter 7. I've told him that if he is caught, he is committing perjury and then he would have a whole new set of serious problems but he is going ahead with it anyway. Is there any way for the courts to verify employment for his spouse without pay information given by my brother?

Not cashing paychecks and failing to disclose income in order to qualify for bankruptcy is a felony. He could go to jail. He needs to discuss this with his lawyer (and get one if he doesn't have one).
