A person in chapter 13 becomes disabled; can the debts be discharged

If you have already filed chapter 13 you would either have to convert to chapter 7 or ask for a hardship discharge. If you have not filed you most likely will have to file chapter 7. go see an attorney face to face.

In your situation the usual course is to convert to a ch7. If the debts are non-dischargeable in a ch 7, you may be able to qualify for a 'hardship discharge' a a part of the ch 13. In any event you should consult with a competent atty.
