Legal Question in Bankruptcy in Florida
Chapter 13 reverted to Chapter 7 by Trustee
I filed Chapter 13 in Jan 2001. My payments were $686.00 per month which I paid monthly until I became ill in late 2003. I wrote to the trustee asking for a reduction in my payments. I have paid more than $18,000.00 and owe $8,000.00 on the original 13. The trustee never answered my request and has now reverted my bankrupcty to Chapter 7. I have many, many more medical & credit card debts. Does the trustee have the authority to decrease my original Chapter 13 payments? I'm at a loss, because it appears that I am back at square one with the Court. The trustee is disregarding all of the paperwork from the Chapter 13 and asking for paperwork which I no longer have.

To provide a meaningful reply, I would need to see the documents concerning your ch 13. Usually an application to the court is required to reduce/amend the confirmed plan.
