Legal Question in Bankruptcy in Florida
Chapter 11
I have won an NLRB case after 7 years against my employer because of unlawful termination. As of last year the damages were $465,000. The company was located in NY. On 7/9/02, they claimed Ch. 11 bankruptcy in FL. My original case was won prior to the Ch. 11, and the final appeal on 6/3/03. What are my chances to see any of the money? They have no more appeals left.

The answewr depends upon the financial condition of the company. The mere fact that it filed Ch. 11 does not mean you will not be paid. The company may hve insurance for such loss. On the other hand the judgment may be re-opened in the bankruptcy court. You should consult with your attorney for a full discourse on the possibilities of collection of your judgment.
