Legal Question in Bankruptcy in Florida
Charged-off credit card debt
I have several credit cards that are showing up as ''charged off'' on my credit report. These were ''charged off'' before I filed Chapter 7 bankruptcy in 07/98. Are these debts not assumed under the bankruptcy? Am I still liable for these debts? If I am still liable why have I not been contacted by the creditors for payment?

Re: discharge of Credit card debt
Unless the creditor has asked the bankruptcy court to specifically exempt the debt from discharge, all credit card debts are extinguished when a bankruptcy discharge is granted. The creditor is not permitted to collect a discharged debt, and the credit reporting agency may change the reported status to reflect the beankruptcy if you follow its procedures for reporting a dispute in writing.
