Legal Question in Bankruptcy in Florida
Child Support Arrearages and Bankruptcy
Can I include all Child Support arrearages if I file
for bankruptcy and will this put a ''stay'' on my
payment of CS until my bankruptcy is complete?
The Child Support order is in Oklahoma and I live in
Florida. I lost my job and have had to take another
paying over $10,000 less. I can barely pay my basic
bills and I have only $100 left in my savings and have
no money left to pay CS.

Re: Child Support Arrearages and Bankruptcy
You will probably have to return to family court to request a modification of your support obligations. C/s is non-dischagreable. If you file the automatic stay will apply, but upon application the court will, probably, lift the stay as to that obligation.
