Child Support & Attorney's Fees under Chapter 7
I am currently paying alimony and child support to my ex-husband who resides in another state (IL). In addition to an increase in alimony payments, he was recently awarded attorney's fees in reference to him pursuing this payment. In addition to other bills this has all but left me broke. My question is, I know that alimony & child support cannot be discharged when filing chapter 7, but can the portion related to the attorney's fees be discharged? Does it make a difference if it is being garnished with the alimony and paid to him directly? Please advise a desperate woman.

Normally, the attorneys fees are not dischargeable but that would go under the law of the state that the award was entered in. It is a complex questions and you should sit down face to face with an attorney.
