Legal Question in Bankruptcy in Florida
Collecting from a Bankrupt Customer
I am a California business owner whose Florida customer (a retail store) is about to fileor may have already filed for bankruptcy. The store is out of business but I think the store was not a corporation. Is there anything I should do now and is there any hope of collecting?

The store might have some inventory or assets remaining. You can sue and obtain a judgment, in case they don't file BK. If you know they have filed a BK, wait to see what kind of notice the BK court sends. If it's an "asset case," the court will send you a claim form to fill out. If so, attach documentation of the debt when you return the form. If it's a "no asset" case, unless you can prove that the store committed fraud, you probably will not be able to recover on the debt.
