Legal Question in Bankruptcy in Florida
i am comtemplating chapter 7 or 13. my concern is that i 3rd party administrate an insurance plan for a client. i also collect an admin fee that collects in the bank account and i have drawn money from time to time. i definately need to insulate this account against creditor claims and be able to disclose the account in court in such a way that purpose of the account is clear ( i show monthly payment to the insurance company) and no obscured by periodic withdrawls and transfers against the admin fee. now that i am looking at Bankruptcy, I realize my business practices are sloppy.

You will need to actually confer with a bankruptcy attorney in your area.
Hello---Is your question: can you file and keep that acct. separate? I would need to ask a few questions myself. Such as...do you have a separate personal checking acct.? Is the acct. for the ins. plan in a corp. name? And I may have a few others. Nevertheless, it seems you could file a pers. BR and identify that acct. with the explanation that it is not yours, thus exempt from creditors.
If my office can be of assistance in Jax., pls, give us a call. I have handled BR cases for 20 yrs. Good luck. Tom Rosenblum
