Legal Question in Bankruptcy in Florida
Credit Card Charges and Assets
My husband works with some people who are considering filing bankruptcy but here is the kicker - they are going out and charging up their cards then they plan on transfering the sister's accounts to the brother's accounts so she can get more cards then they will do the same with the brother's. Wouldn't this be considered fraud? And what effects do cash advances have on filing bankruptcy when paying off the creditor?? Also, when filing bankruptcy how much of your personal assets are exempt and how does one go about finding this out?

Re: Credit Card Charges and Assets
Your question is rhetorical in nature. The answer is clear. Because you are not the party in interest, any further reply would be for discussion purposes and that is beyond the purposes of this service. The extent of available exemptions are based upon the nature of the asset and relevant State law as applied in the bankruptcy arena.
