Legal Question in Bankruptcy in Florida
My daughter and I own a house in joint tenency. It is homesteaded as it is my home and I live here full time. How does her half ownership effect her in filing a chapter 7 or 13. The home is not a liquid asset.
She would prefer to be able to file 7.

If she does not live there, then it is an asset that she will have to claim. If she lives there, then it is her homestead property, also, and she does not have to surrender it in a 7. A 13 allows her to keep her assets, such as your house. She really should see a Bankruptcy attorney. She can call my office at 954-825-0414 if she lives in South Florida.
