Legal Question in Bankruptcy in Florida

Dismissed Bankruptcy

My bankruptcy was dismissed as I was overseas in the United States Air Force. The attorney I obtained has not been much help as I have returned home to find this information. DO I have any options on handle to this as I would like to refile?

Re: Dismissed Bankruptcy

Look at the order of dismissal from the court. If it says (180) day injunction, you are precluded from filing for that period from the date of dismissal. If the case was dismissed less than ten (10) days ago, you could file a motion for reconsideration asking the court to reconsider why your case was dismissed. Also, you could retain an attorney to file a motion to reopen your case for the purpose of asking the court to shorten the injunction period so you can re-file again. Depending on your situation, some judges would be sympathetic, particularly if you filed the bankruptcy for the purpose of saving a house in foreclosure.
