Legal Question in Bankruptcy in Florida
Ex-spouse files BKC 7 in Texas but has outstanding joint car loan
My boyfriend and his ex-wife have been divorced for four years. On the final judgement of their divorce both agreed to refinance their corresponding cars. The car loans are existing loans and are under both of their names. The car payments for the ex-wife's car are automatically deducted from my boyfriend's paycheck and she is suppose to reimburst him monthly. She is currently thireen months behind making payments to my boyfriend. She lives in Texas and we live in Florida. She has just filed for Chapter 7 stating no assets. How do we protect my boyfriend's credit? Do we have any rights? Can we request the car back in order to recoup monies that we have paid and are still owed on the car loan?

I suggest your boyfriend contact his attorney. In such manner he would do best in protecting his interests. If he not successful, then re-submit your question or callme, detailing the results of the consultation with his attorney.
