Legal Question in Bankruptcy in Florida
My father recently passed away and is survived by my mother. He left credit card debt some of which is due to medical expenses and pharmacy bills. He had ownership of a vehicle in Florida not in her name and no income other than social security that I am aware of at this time. A home in South Carolina mortgage to a local bank that is supposed to go to the renters on his and my mothers passing. As far as I know he had no life insurance. Can or should my mother declare bankruptcy since the credit card debt is close to $30K and their combined monthly income from social security was only $1500 a month which will now be closer to $1000 a month?

There may be no need to file unless the credit card debt was a joint obligation. I suggest that your mother meets with a bankruptcy attorney local to her area. Most attorneys offer a free initial consultation which should help your mother decide whether bankruptcy is right for her.
