Legal Question in Bankruptcy in Florida
I have filed bankruptcy. The hearing is October 12, 2009 in Tampa. I own the Title to a 2007 Saturn Aura. It has been promised as collateral to my mother for an $8,000 loan for custody legal fees. Can the court take our car away? Can they stop me from using it as payment to my mother? The blue book is around $6500. The exemption list being used allows me $2,550. What should I do?

Yes, the court can take the car away and return the exemption value to you. You can't save the car by pledging it to your mother. If that were so, everyone would pledge all their assets to relatives to escape the consequences of bankruptcy.
