I have lawsuits from creditors but i'm also having foreclosure in my property. If i file backrupcy and save my home, will the judgements for the creditors prevail?
1 Answer from Attorneys
Generally so long as you provide proper notice to unsecured creditors then the debt, whether it is in the form of a judgment or not, will be discharged. As with any area of the law, bankruptcy can be complex and there are exceptions to the general rule.
You should consult with a bankruptcy attorney as soon as possible.
I am concerned about your intention to file bankruptcy to save your home. Given your desire to keep your house you should absolutely consult with an attorney to determine which type of bankruptcy is right for you and the type of payment you can expect to keep your house.
