Legal Question in Bankruptcy in Florida
how do liens on property affect disposition of property
If a relative is filing bankruptcy and is an authorized user on my credit card with a substantial balance owed to me can I place a lien on their personal property such as home or boat in order to make the debt secured? The family member does not want to dismiss the debt but has no legal obligation to pay the creditor. Can I place a lien on her property and then will that protect her property or can she turn over her property to me prior to filing as payment on a debt?

The legal term is called a preferential transfer to a friend or family member and can be voided by the bankruptcy court. Speak directly with a bankruptcy attorney to develop a plan to protect your interest. A.J. Comparetto, Esq. 727-328-7900
