Legal Question in Bankruptcy in Florida
I live in Florida. My husband had a vehicle repossessed over 5 years ago. We have received calls from time to time over the years, but have not and are still not able to pay on the remaining balance. Is there a period of time after which they would stop calling, or is his only choice to file bankruptcy?

You can stop a debt collector from contacting you by writing a letter to the collection agency telling them to stop. Once the agency receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or creditor intends to take some specific action. In general, in Florida, the statute of limitations on a written contract is 5 years from the date of last activity, such as the last payment on the account. However, if they get a judgment prior to this they can extend that date indefinitely
