Legal Question in Bankruptcy in Florida
Loan payment
the small company I work for was in money trouble. The owner of the company asked me to loan her $45,000. I gave her cash and also took no paycheck to make up the money. I have a note from her saying she will pay back the money. I also have the books showing I took no paychecks. My question is ..she is now going to go chapter 7-11 or 13. Will my repayment of this loan go in with all the other creditors or if I sue her before she files do I stand a better chance of not being tossed on the creditor pile? please help

Your loan will go on the pile with all the other creditors. It doesn't matter when you sue.
