Legal Question in Bankruptcy in Florida

i am getting married the 12 Dec, I hired a photographer that i found through Google he works from home and mentioned that he had to close the shop due to the economy and working from home etc, reasonable reasons with the economy these days. i have paid him over $700 in deposits of a $1800 bill. i have my engagement pictures coming up and tried to reach him, the phone number is disconnected his website is down, i have not gone by his house where we signed the contract (his office)because i want some legal advise. I am worried that this photographer might go bankrupt or out of business and I may be left loosing $700 and no pictures for the most memorable day of my life. I signed with him based on him having an established business web site and being able to contact him. What can I do? How should I proceed I do not want to risk the happiest day of my life.

If he files chapter 7 bankruptcy, it's very likely that you'll lose your deposit. If he files chapter 13 bankruptcy, you may get a portion of your deposit back over time, but I wouldn't count on it.

Right now, it sounds like you need to find another photographer. You may want to try filing a small claims complaint against this guy, but if he files bankruptcy, your lawsuit will likely be worthless. It may be worthless even if he doesn't file bankruptcy.
