Legal Question in Bankruptcy in Florida

What can I keep?

I am married, and we would be filing jointly. I have thru my work a 401K, we have a very small (and getting smaller, I'm sure) investment fund. I also have a car that has about 8,000 left to pay with the(blue book value 7500ish). My husband has a paid off beat up work van that no one in their right mind would want. thats it. we are divorcing, and my car is necessary to get to work..this seems to be a grey area, though. can you clarify? also about the investments? thank you so much.

Re: What can I keep?

Not a gray area at all. Your car has no equity. You keep making the payments and reaffirm the debt you keep it. 401(k)'s are exempt under Florida Law. Your husbands work van has an exemption limit of $1,000 of equity.
