Legal Question in Bankruptcy in Florida

Medical Bill

A few days ago I received an expensive medical bill

from a physicians medical group for service almost a

year ago. The bill was for treatment that we needed

for our newborn child. Our insurance company at the

time is now refusing to pay which I'm looking into.

My wife and myself filed for Bankruptcy on October

29th 2000 and our Discharge was issued in February

2001 and the medical services were rendered in

September 2000. At the time we filed for Bankruptcy we did not list this physicians medical group as a

creditor because at the time we didn't owe them

anything because they billed our insurance company

directly. Now almost 1 year latter we get this bill

that we didn't even know existed and they're coming

after us for the payment.

Now because the services where rendered before the

filing of the Bankruptcy are they part of the

Bankruptcy? Our case was also a No Asset case

If your case is closed (Check with the clerk of the court), you need to reopen your bankruptcy case to add the omitted creditors. You will also need to file an adversary proceeding (a law suit within the bankruptcy case)against the omitted creditors asking the court to discharge their debts. Filing fees are involved and the procedure is complex. If the case is still open, just file amended schedules to reflect the omitted creditors, pay the fee to amend, notice the creditors, and you are done with it. Good luck.
