Legal Question in Bankruptcy in Florida
My mother is in chapter 13 bankruptcy, myself and children live with her. What happens to the residence if she passes away while still in bankruptcy? Myself & my brother are named beneficaries in her will.

The residence apparently passes to you and your brother. But if she passes away, the mortgage still has to be paid. If it is not paid, the home will be lost. The bankruptcy would die with your mother. If you are concerned about your status, you do need to go see an attorney. The residence does not pass automatically, you have to get that done through a probate.
