Moving after chapter 7
How long do you have to stay in your home after your chapter 7 is complete? I have received a ''Motion for Summary Judgement of Foreclosure''. We have received our final paper work on the chapter 7, this week all done. Trying to get a better idea how much longer we can stay in the home? Is there a set time after this motion for summary judgement? Does someone call and tell you when to get out? Does the bank just come and lock the door? Any help with this would be greatly appreciated. Thanks,--name removed--

You didnt say what the final paperwork on your ch 7 was. I assume it was an Order of Discharge. The Motion for Summary Judgment should have been accompanied by a Notice of Hearing. The date of the hearing will likely be the date a judgment is entered. Get a copy of that judgment when it is entered and it will specify the date of the sale, thEn start pACKING. cOULDNT YOUR BANKRUPTCY LAWYER TELL YOU THIS?

I agree with the previous reply. To add a bit, you best be out 10 days after the sale. There are colateral questions, but the foregoing answers your's.
