Legal Question in Bankruptcy in Florida
order of dismissal due to slow payments.. irs involved.
our ch 13 plan was confirmed nov.2000. our payments were 1200/mo in the beginning. due to bogus irs claims, we were charged another 300/mo and promply became deliquent with our payments. (we only filed to be able to pay outstanding student loans.) now we are 3500 behind (with regular $1000 payments) and we have a court date on 4/17 for a motion to dismiss filed by the trustee. we have been sent the disbusement activity report, and the lawyer, irs (excluding penalties) and most arrearages have been paid as of 12/31/01. we had very little credit card debt and one fema loan from the sba. irs's 4500 payment off the top has put us back in the hole, but we can prove this to be a bogus claim. (who knows when we would get this back?!) they won't talk to us while in ch 13. if we convert to ch 7, will we get our money back from the irs at all?? will penalties acru while we try to see our irs representative? should we forget ch 7 and take back our debt. how would this work? please advise asap.

You obviously have a complex problem. You should sit down with your attorney face to face and get answers.
