Legal Question in Bankruptcy in Florida
"Are pay day lenders creditors?"
I have "pay day lenders" I owe. Do I have to include them as creditors on my Bankruptcy? Also, are they allowed to deposit my personal check after they have been notified that I have filed Bankruptcy? These pay day lenders hold my personal check til my next pay period and advance me the funds. I pay them a fee for this service, which is considered the same as paying interest on a loan, I think.

Pay Day Loans
Yes, a pay day loan is just like any other creditor. I assume you gave them a post dated check to pay the loan (and fees) once you get paid. By all means list them on your bankruptcy (and stop payment on the check).
