Legal Question in Bankruptcy in Florida
Preferential transfer
A debtor filed banruptcy who was my tennant. They were behind on read and then paid in full which was within 90 of thier filing. The trustee says this ($2,100 rent balance) was preferential.
(1)Is there some exception being that it was for their personal shelter?
(2) Does the trustee get to keep most of this or do you know the percentage going to trustee/creditor?
(3)Is bankruptcy court only before the judge and no jury available?

Would like to know 1. who made the payment on behlf of the debtor and 2. was the entire payment made for past due rent...or was part for current rent. Resubmit your question or call me.
