Legal Question in Bankruptcy in Florida
Propery Exemptions
I have a loan in my name for a truck I bought for my son. The truck is titled in ''his'' name, but I am making the payments. He needs the truck to work (he works full time but does not make enough to pay for the truck and insurance). Will the truck be confiscated under bankruptcy? Also, we have another handicapped child at home. Will we lose all but one vehicle or will my wife be able to keep her car for his care and transportation and I keep my vehicle for work? I am currently out of work (since 1 Oct 03) but am searching for employment.

Re: Propery Exemptions
Without knowing who the bankrupt is, I find it most difficult to provide a meaningful reply to you question. In addition you omit saying who owes what on which cars. Suffice it to say, that if payment is not made, the car is subject to being repossessed. You should seek the advice of competent bankruptcy counsel in your locale.
