Legal Question in Bankruptcy in Florida
I'm getting ready to file chapter 7 bankruptcy in Florida. I am an heir to my dad's probate in Florida. However it's been ongoing for about 3 years now and I have no idea when it will be done or even if there will be any thing left coming to me at the end. How will this affect my filing?

The money that you are entitled to receive from your father's estate is an asset that you must list on your bankruptcy schedules. The Trustee, who is the person who will manage your bankruptcy case, has the right to receive all or most of what you are entitled to receive from your father's estate. This means that you may not get anything from the estate. So, you should weigh your options carefully before filng for bankruptcy. You may be successful in wiping out your debts, but you may lose everything that you will inherit.
