Legal Question in Bankruptcy in Florida
Real property transfers & bankruptcy
My mother-in-law is transferring deed on inherited family property, which is not her residence,to my husband.My husband would have inherited said property upon her death. Her place of residence is in Florida and the property transferred is in Georgia. How long must she wait to file bankruptcy for this not to be considered a fraudulent conveyance?

I am not so certain yours is as much an issue of a fraudulent conveyance as it is a preferential transfer. If it is a preferential transfer then one year.
